We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
We work exclusively on the basis of the German Freight Forwarders' Standard Terms and Conditions (ADSp), in each case in the latest version. Clause 23 ADSp limits the statutory liability for damage to goods in accordance with Section 431 of the German Commercial Code (HGB) for damage while in the custody of the freight forwarder to 5 EUR/kg; in the case of a transport contract involving carriage by different means of transport to 2 SDR/kg and, furthermore, per claim or loss event to 1 million or 2 million EUR or 2 SDR/kg, whichever amount is higher.
